Greetings and welcome to our website, while using our services, User (“You”, or “Your” or “Member” or “Customer”) agree and provide your consent to the terms and conditions of usage mentioned herein (“Terms of services”)

These terms of services on our website may be updated/Amended from time to time and it is user responsibility to check our terms of usage frequently to stay updated with our terms of services.

General Descriptions

Yourkundli is a website that provide Astrological content, data, report, email, video and telephone consultations (“Content”) through world wide web, application and electronic mail. The website provides “free services” as well as “paid services”, (collectively referred as services). Free services can be accessed without becoming a member. However, in order to use additional services and content the user have to register as a paid member. By registering, the User agrees to:

• The user agrees to provide complete, current and accurate information about himself as prompted by the website
• Maintain and keep your information up to date as required and submitted by yourself with a view to have the accurate information that is current and complete.

User Eligibility Criteria

Services to the website are available only for the individual who is over the age of 18 years and who can form legally binding contracts under applicable law. Services are not permitted to be used by minors. We are not responsible for any misuse that may arise by virtue of any individual including a minor using the services available on the Website.

Website does not permit the use of the services under following conditions:

User Registration

The user can register through the website using email ID and password or phone number and OTP and provide update, current accurate information while filling the sign in form. You are entirely responsible to maintain the confidentiality of your account such as User ID and Password. The user is fully responsible for all activities that occurs under the user’s account with the website, whether or not actually or expressly authorized by you.  

You can change your password from time to time by following the instruction on the website and maintain security and confidentiality of your account. You acknowledge and agree that you User ID and password will not be sold or transferred to another third party. User hereby consent for the unconditional access of the account by the website employees and agents to investigate on case-by-case basis from the records available to address any complaints (If received), suspected abuse or other allegations reported.

Breach and Termination

The website may modify, change or discontinue, in whole or in part, the services of your account without prior notice or provide any reason with no liability to you, any other user or any third party. We reserve the right to terminate your account immediate if,

• We are not able to verify or authenticate your registration data or other information provided by the User
• We believe that the User actions may cause legal liability to yourself, website, service providers or any other users on the website.
• We believe that the User provided us with false and misleading registration data or interfered with other users or the administration of the services .

Privacy Policy

We give high importance to privacy policy and may update from time to time and it is available on the website, we amend our privacy policy in pursuant to these terms of services. We advise users to check regularly and remain in compliance with these Terms of services and privacy policy.

Refund and cancellation policy of services and Product

• There will be no refund if the User has initiated/placed the order of any report or starts the services with an Astrologer. We don’t take any responsibility of any quick decisions or carelessness made by the User for placing an order
• Any network or technical issues encountered on the website at the time of order or services has been placed and requested by the user, The Astrologer shall not be eligible for claiming refunds.

• No refund shall be made if the User provide a wrong phone number for placing the order, it is user responsibility to enter correct phone number before connecting with the astrologer.
• All refunds shall be processed after deducting the transaction charges levied by the bank and / or the payment gateway, or any other charges that may have been borne by the website for processing and / or delivering the service, as applicable.
• Multiple payment made for single order, one of the payments will refunded in full without any deductions and the User will be charged only on one single order.
• When the user request for a refund, the user agrees to provide unconditional permission to YourKundli Admin team to monitor the Chat and call recordings of that particular order to check the eligibility of refund.
• If there is a quality issue with the obtained services/order, our admin team will investigate for eligibility before making any refunds.
• Once the Yourkundli Admin team have done with the investigation on the refund request and if eligible, the amount will be credited back to User’s wallet in 3 business working days or 72 hours.
  • The website will consider the refunds if:
    • Services (Chat/Call) is affected due to Internet/Server/Network issues.
    • Communication gap between Astrologer and User or the Astrologer is unable to communicate in the language mentioned in profile. Or the user is unable to hear the voice of Astrologer due to weak signal.
    • There is a communication gap between Astrologer and User or the Astrologer taking longer duration to respond.
    • Astrologer has not responded back appropriately to the user query.
  • No refund shall be made if data provided by User is incorrect.
  • No refund shall be made due to lack of accuracy. We don’t take any responsibility on factual accuracy of any consultations or predictions.
  • Kindly note: All product that are physical is shipped within India, we do not ship any physical products outside India
• No refund shall be made for returning the damaged product, the user agrees to take full responsibility of any damages caused to the product after delivery
• For returning orders placed using Cash On Delivery methods, the user agrees to be charged the courier/shipping charges as applicable.
• The user agrees that the picture of product displayed on the website are for reference purpose and the website will try to deliver product ordered by the user AS-IS condition which is displayed, we advise the user to exercise discretion and no refund shall be made in these scenarios.

• The product sold or services offerings are strictly not to replace any medical treatment, emotional or philosophical conditions. We don’t hold any liability or responsibility about the reliability of the astrological effects on human physiology, by the gems represent and sold on the website. The order placed by the User for buying product or services is solely on the discretion and free will of the User and the website take no responsibility. We advise the user to exercise discretion and no refund shall be made in these scenarios.
• If the User received the product in damaged or defective or broken condition while in transit. User can raise a ticket for replacement or refund within 48 hours of delivery of the product along with the pictures of damaged or defective items, we will investigate the cause of the issue and upon successful verification the refund will be provided. The ticket can be made on our website through support chat or email us at support@yourkundli.com please note: - Any request raised for refund or replacement after 48 hours of delivery of the product will not be accepted.
• The product must be returned in the original condition the same way it was received along with package, labels and bills. The user can raise a ticket for replacement or refund within 48 hours of delivery of the product.

Behaviours and Restrictions

The user agrees that he is an individual and not a corporation or a company. And the user agrees not to make any commercial use or resell our services without written confirmation of the website. The user is solely responsible for the contents that he transmits through our website. Your use of our services is subject to all applicable local, state, national and international laws and regulations.

You agree to the following:

• Comply with all Indian laws regarding the transmission of technical data exported from the India through the Service;
• not to use the Website or the Services for illegal purposes.

• Comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding Your use of the Services. yourkundli.com makes use of the Internet to send and receive certain messages; therefore, your conduct is subject to Internet regulations, policies, and procedures. You will not use yourkundli.com for chain letters, junk mail, spamming, or any use of distribution lists to any person who has not given specific permission to be included in such a process. You agree not to transmit through Yourkundli any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. You further agree not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national or international law or regulation. Attempts to gain unauthorized access to other computer systems are prohibited. You shall not interfere with any other yourkundli User’s' use or enjoyment of the Website or Services.

No warranty. You understand and agree that:

• The services are provided "as-is" and with all faults. Yourkundli assumes no responsibility for availability (or lack thereof), timeliness (or lack thereof), deletions, misdeliveries, or failures to store any member communications or personalization settings
• In particular, but not by way of limitation, yourkundli may delete e-mail or other accounts or the information therein if the account is inactive for more than 3 months.
• Use of the services is at your sole risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data;
• The services are provided for entertainment purposes only and yourkundli, on behalf of itself and its suppliers, disclaims all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, title, or non-infringement and it makes no warranty or representation regarding the results that may be obtained from the use of content or services, the accuracy or reliability of any content obtained through the services, any goods or services purchased or obtained through the website, or any transactions entered into through yourkundli.com's site, and makes no warranty that the services will meet your requirements, be uninterrupted, timely, secure or error free. No advice or information, whether oral or written, obtained by you from yourkundli or through the services shall create any warranty.

Limitations Of Liability

In no event will yourkundli or its suppliers be liable for any indirect, incidental, special, consequential or punitive damages of any kind, including but not limited to damages for loss of profits and the cost of procurement of substitute goods and services (collectively, "indirect damages") arising out of or in connection with our website, the services, our privacy policy, or these terms of service (however arising, including negligence), even if yourkundli had been advised of the possibility of such damages. Without limiting the foregoing, yourkundli and its suppliers will not be liable for indirect damages arising out of or in connection with:

• Any goods or services purchased or obtained through yourkundli site, or messages received or transactions entered into through yourkundli services;
• Loss of, unauthorized access to, or alteration of, a user's transmissions or data.

The liability of yourkundli and its suppliers to you or any third parties arising out of or in connection with our website, the services, our privacy policy, or these terms of service (however arising, including negligence) is limited to the greater of (a) the amount of fees you pay to us in the twelve (12) months prior to the action giving rise to liability, or (b) $200.

Indemnification:

You agree to indemnify, defend and hold harmless yourkundli and its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of the services, your violation of the privacy policy or these terms of service, or your violation of any third party's rights, including without limitation, infringement by you or any other user of your account of any intellectual property or other right of any person or entity. These terms of service will inure to the benefit of yourkundli’s successors, assigns, and licensees.

Proprietary rights to content:

You acknowledge that the Content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or distributed via email, commercially produced information presented to Member by yourkundli, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, patents and/or other proprietary rights and laws. You are not permitted to copy, use, reproduce, distribute, perform, display, or create derivative works from the Content unless expressly authorized by Yourkundli, its suppliers, or advertisers.
 

NOTICES. Except as otherwise stated in these Terms of Service, all notices to a party shall be in writing and shall be made either via email or snail mail. Notice shall be deemed given 24 hours after an email is sent, or 3 days after deposit in the snail mail, to Member at the address provided by Member in the Registration Data and to yourkundli at the address set forth below:

General Provisions

These Terms of Service will be governed by and construed in accordance with the laws of India without giving effect to any choice of law principles that would require the application of the laws of a different state. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms of Service or Privacy Policy to be unenforceable or invalid, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law, and the remainder of the Terms of Service or Privacy Policy, as applicable, will continue in full force and effect. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by yourkundli. These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.

The information collected by the Website may be used for any purpose as may be permissible under the applicable law and shall include but not limited to the following: -

You understand that we only provide a platform where astrologer can give astrology services to users and we do not have any direct, indirect control over the conversation happens between the astrologer and users. You use the services at your own risk and you will be responsible for any loss, harm incurred due to such conversation/recommendation. In no case yourkundli or any of its directors/ officials will be liable for any such loss/harm.

Example, we don’t make any warranties about:

(a) the recommendation provided through the service;

(b) the specific features of the service, or its accuracy, reliability, availability, or ability to meet your needs;

The website is offering services through a diverse panel of astrologers duly verified by the website and such service provider (astrologer) may from time to time make recommendations of using mantras, gemstones or other astrological remedies to be used by user. Such recommendations are being made in good faith by the astrologers and the website and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors make no warranty that:

• The service will meet your requirements
• The service will be uninterrupted, timely, secure or error - free
• The results that may be obtained from the use of the service will be accurate or reliable
• The quality of any products, services, information or other material purchased or obtained by you through the service will meet your expectations and
• Any errors in the software will be corrected. You are required to make full disclosure about the emotional, mental and physical state of the person seeking advice from the panel of astrologers of website so that the astrologers make an informed judgment about giving advice.

You will not exchange any personal contact information with any astrologer/consultant for any purpose, which may include making offline payment or in-personal meetings.

You must not share any personal information about yourself, your friends, acquaintances, family members, or anybody else with whom you may or may not be associated. Contact numbers, bank account numbers, e-mail addresses, websites, personalized pages, blogs, and social media profiles [including but not limited to facebook, wechat, whatsapp, telegram, messenger, sms, and others] are all examples of personal information. You also do not induce astrologers/consultants for offline meetings.

Yourkundli will not be responsible for any harm or loss incurred due to the violation of this clause.
